1. General Disclaimer

The information, products, services, and content provided by Perisync Technologies Pvt Ltd under the brand name TheWaterFirm ("TWF") — including but not limited to the website at www.thewaterfirm.com, the TWF mobile application, the TWF cloud platform, and any associated documentation or communication — are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied.

To the fullest extent permitted by applicable Indian law, TWF disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted availability.

This Disclaimer is to be read alongside TWF's Terms & Conditions, Warranty Policy, and Privacy Policy.

2.Metering Data & Accuracy

TWF's smart water metering system provides water consumption data derived from IoT-based metering hardware. While TWF makes reasonable efforts to ensure the accuracy of readings under Normal Operating Conditions, the following limitations apply:

• Readings are generated by hardware operating in real-world plumbing environments and may be affected by air trapping, mineral scaling, pipe fouling, biological buildup, pressure anomalies, water hammer, reverse flow, or sub-threshold flow conditions;
• Data transmission gaps may occur due to gateway power loss, cellular network downtime, SIM provider outages, or other connectivity interruptions outside TWF's control;
• Consumption data displayed on the Platform reflects readings received by the system. Periods of connectivity loss result in data gaps that cannot be retroactively filled;
• Meter accuracy is specified as a percentage tolerance under standard operating conditions as stated in the product's technical specification sheet. Readings within this specified tolerance are considered accurate and are not a basis for claim;
• Cumulative calibration drift over extended operational periods is a characteristic of all flow metering devices and does not constitute a defect.

3. Billing Data

Water billing amounts displayed on the TWF Platform are calculated by multiplying meter readings against water tariff rates entered and maintained by the Building Admin or Association. TWF is not responsible for:

• Incorrect billing amounts resulting from incorrect, outdated, or unapproved tariff rates entered on the platform by the Building Admin;
• Changes in municipal or authority water rates that have not been updated on the platform;
• Billing discrepancies arising between TWF's data and manual or alternative metering systems previously in use at the property;
• Resident disputes arising from water billing based on consumption data reported by the system, where the data was generated under Normal Operating Conditions;
• Any financial loss, penalty, or legal consequence arising from billing decisions made using data from the Platform.

The Building Admin and Association are solely responsible for setting, reviewing, and updating the water tariff rates on the Platform and for communicating billing terms to residents.

4.Regulatory & Metrological Compliance

TWF's smart water metering system comprises IoT-based hardware for water consumption monitoring. The system may include meters, sensors, and communication devices from various manufacturers — including TWF's own hardware, branded third-party meters, or OEM-sourced components — depending on the specific deployment.

TWF makes no representation, warranty, or assurance that any hardware supplied as part of its system — regardless of make, model, manufacturer, or origin — meets the requirements of the Legal Metrology Act, 2009, the Legal Metrology (General) Rules, 2011, any Bureau of Indian Standards (BIS) specification, or any other statutory, regulatory, or certification standard applicable under Indian or state law, unless such certification is explicitly confirmed in writing in the applicable Service Contract for that specific installation.

• The applicability of metrological, statutory, or regulatory certification requirements to any specific installation depends on the nature of the use, the applicable state regulations, local authority directives, and the specific law in question. These requirements vary and are subject to change;
• TWF does not determine, assess, or advise on whether a specific installation requires any form of regulatory certification. That determination is entirely the Customer's responsibility;
• Customers must independently verify — with qualified legal or regulatory advisors — whether the hardware deployed at their property is required to meet any certification standard under applicable law for their specific use case;
• In the absence of explicit written certification confirmation in the Service Contract, the hardware should not be represented or relied upon as a legally certified instrument in any statutory filing, regulatory submission, or legal proceeding where such certification is required.

5.Platform & Service Availability

TWF does not guarantee that the Platform, mobile application, or any associated service will be available continuously, without interruption, error-free, or free from technical faults. Planned or unplanned downtime may occur due to maintenance, software updates, infrastructure issues, or factors outside TWF's control.

• TWF shall not be liable for any loss or inconvenience resulting from temporary unavailability of the Platform;
• Service availability commitments, if any, are as specified in the applicable Service Level Agreement (SLA) in the Customer's Service Contract — not in this Disclaimer;
• TWF reserves the right to modify, suspend, or discontinue any feature of the Platform at any time. Where a core feature is discontinued, TWF will make reasonable efforts to notify active users in advance.

6. Website Content

The content published on TWF's website (www.thewaterfirm.com) — including product descriptions, case studies, technical specifications, pricing indications, FAQs, blog posts, and other material — is provided for general information purposes only.

• Website content is subject to change without notice and may not always reflect the most current product specifications, pricing, or service terms. The applicable Service Contract governs over any website content in case of conflict;
• Case studies, testimonials, and deployment examples on the website reflect specific past implementations and do not constitute a guarantee of similar results for any other Customer or property;
• Technical specification data published on the website is provided as a general reference. Actual product specifications are as detailed in the product's official technical specification sheet provided at the time of supply;
• TWF makes reasonable efforts to keep website content accurate and up to date but does not warrant that all content is free from errors, omissions, or outdated information.

7. No Professional Advice

Nothing on TWF's website, platform, documentation, marketing material, or in any communication from TWF constitutes:

• Legal advice — including advice on tenancy law, housing society regulations, Legal Metrology compliance, or consumer rights;
• Engineering or plumbing advice — including advice on pipeline design, pressure systems, water treatment specifications, or civil infrastructure;
• Financial advice — including advice on water tariff setting, cost recovery, or billing strategy;
• Regulatory compliance advice — including advice on RERA, building byelaws, municipal regulations, or any other statutory compliance requirement.

Customers and users should seek qualified professional advice for matters in the above categories. TWF's communications and support relate solely to the operation of its smart water metering products and platform.

8.Marketing & Promotional Claims

TWF's marketing material, website, sales presentations, and promotional communications may reference performance figures, efficiency improvements, savings estimates, or operational benefits. The following applies:

• All performance claims are based on typical deployment conditions and historical data from past installations. Actual results will vary depending on property size, plumbing infrastructure, water quality, occupancy levels, and usage patterns;
• Estimates of water savings, billing accuracy improvements, or revenue recovery are indicative only and do not constitute a guarantee of specific outcomes;
• Free services, complimentary inclusions, or promotional offers described in marketing material are valid only as specifically stated in the applicable Service Contract. Marketing material does not override contractual terms;
• Product images and screenshots used in marketing material are illustrative. Actual product appearance and user interface may differ from those depicted.

9.Third-Party Links & Services

TWF's website and platform may contain links to, or integrate with, third-party websites, applications, or services. TWF does not endorse, control, or accept responsibility for the content, availability, accuracy, security, or practices of any third-party website or service. Accessing third-party links or services is entirely at the user's own risk and subject to the third party's own terms and policies.

This includes but is not limited to: payment gateway providers, facility management platforms, mapping or location services, and cloud infrastructure providers.
